Women Are Dying Waiting for Johnson & Johnson's Settlement Proposal To Be Decided

Some women with ovarian cancer think that Johnson & Johnson is deliberately stalling hoping they will just die

Tuesday, June 20, 2023 - Johnson & Johnson and the 45,000 or so talcum powder cancer lawsuits continue to wait to see if claimants will approve the company's latest talcum powder cancer settlement offer of $8.9 billion dollars. While the amount seems large on its face, it amounts to about $150,000 for each of the 60,000 or so total claimants talcum powder lawyers are said to have signed up. Claimants differ from plaintiffs in that claimants have only registered their intent to file a lawsuit. This is noteworthy as the New Jersey Bankruptcy Court created a moratorium for filing lawsuits that lasted more than a year during which time Johnson & Johnson created a spin-off company called LTL management and placed all of the talcum powder lawsuits in it along with the settlement amount of $2 billion. The amount was recently increased to $8.9 billion after the reversal of LTL management's bankruptcy. Regardless of the amount of the settlement offer, women with ovarian cancer who are suing Johnson & Johnson are incensed over the company's stalling tactics and think that the Johnson & Johnsons strategy is to delay trials as long as possible hoping that plaintiffs die and the survivors not follow through with their lawsuit. NBCNews recently reported the story of one woman with ovarian cancer whose circumstances are similar to thousands of other women suing Johnson & Johnson. They wrote: " Plaintiff Deborah Smith's case was held up for 15 months because of the attempted maneuver, a legal strategy colloquially known as the Texas Two-Step. J&J's approach relied on the creation of a subsidiary called LTL Management that could take on the liability for talc-related legal claims. Within days of its creation in 2021, LTL filed for Chapter 11 bankruptcy." Ms. Smith told NBCNews, "If that was someone in their family, would they drag it out like that?" Smith said. "It's almost like they're playing a waiting game to see how many people will just die or just give up fighting." Smith's lawyers point to about 25 independent scientific studies that show a link between using talcum powder for feminine hygiene and developing ovarian cancer according to NBC.

Ovarian cancer is a deadly disease whose symptoms are commonly overlooked. Statistics reveal the gravity of the situation. Studies indicate that the five-year survival rate for ovarian cancer is dishearteningly low, with only about 47% of women surviving beyond this critical timeframe. This alarming figure underscores the urgent need for improved detection methods and heightened awareness. The deceptive nature of ovarian cancer symptoms further compounds the issue. Bloating, pelvic pain, and fatigue--hallmarks of the disease--are frequently dismissed as routine menstrual experiences, preventing early suspicion. As a result, the warning signs are frequently ignored until cancer has already progressed to advanced stages, severely limiting treatment options and reducing survival chances. Unfortunately, there is currently no widely available screening test for ovarian cancer that rivals the effectiveness of mammograms or Pap smears. This absence of routine screening exacerbates the challenge of early detection and contributes to the high mortality rates associated with this silent killer.
